These Terms of Use (“Terms”) govern your access to and use of the BattleCorp Network website and online services (collectively, the “Service”) operated by NET247 and its affiliates (“we”, “us”, or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

We may update these Terms from time to time. The “Last updated” date above reflects the latest revision. Continued use after changes constitutes acceptance of the revised Terms.

1. Eligibility and the Service

The Service is a community-oriented platform for game-related statistics, squads and organisations, profiles, leaderboards, and related features, including optional API or server integration where we make such capabilities available. You must be able to form a binding contract in your jurisdiction and meet any minimum age we require under applicable law to use the Service. You are responsible for ensuring that your use complies with the laws that apply to you.

2. Accounts and security

To use certain features you may need to register an account. You agree to provide accurate, current information and to keep it updated. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly via the contact page if you suspect unauthorised access. We may offer security features (such as two-factor authentication); you are encouraged to use them where available.

3. Acceptable use

You agree not to:

  • Violate any applicable law or regulation, or infringe the rights of others.
  • Harass, threaten, defame, discriminate against, or harm other users or third parties.
  • Upload or distribute malware, attempt to gain unauthorised access to the Service, our systems, or other users’ accounts, or interfere with the integrity or performance of the Service.
  • Scrape, crawl, or harvest data from the Service in breach of these Terms or technical measures we employ, except as expressly permitted (for example, through documented APIs and rate limits we specify).
  • Use the Service to send unsolicited or bulk communications without consent, or to operate fraudulent or deceptive schemes.
  • Misrepresent your identity, affiliation, or the origin of any content, or manipulate rankings, statistics, or telemetry in a way that deceives users or undermines fair play.
  • Use the Service in connection with cheating, exploits, or other conduct that violates applicable game or platform rules, where such use is directed at or harms the Service or community.

We may investigate suspected violations and cooperate with law enforcement or right holders where required.

4. User content and licence

You may submit or display content through the Service (for example profile fields, squad or organisation information, messages where the Service allows, and similar material) (“User Content”). You retain ownership of your User Content, subject to the licence below. You represent that you have the rights necessary to submit User Content and that it does not violate these Terms or applicable law.

You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, modify, display, and distribute User Content as reasonably necessary to operate, improve, and promote the Service, including as aggregated or anonymised data where permitted by law. You may withdraw User Content by deleting it or closing your account where the Service allows; some copies may persist in backups for a limited period.

5. Game data, third-party titles, and APIs

Statistics, events, or other game-related data may be supplied by game servers, mods, clients, or third-party integrations. Such data may be incomplete, delayed, or incorrect. The Service is not endorsed by, sponsored by, or affiliated with game publishers or platform operators unless we state otherwise in writing. Game names, marks, and assets are property of their respective owners.

Where we provide APIs, tokens, or webhooks, additional technical or contractual rules may apply. You must not misuse credentials, exceed fair use, or use integrations in a way that harms the Service or other users.

6. Intellectual property

The Service, including its design, software, branding, and our original content (excluding User Content and third-party materials), is owned by us or our licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are granted to you. You may not copy, modify, distribute, or create derivative works from our materials without prior written consent, except as allowed by mandatory law.

7. Third-party services

The Service may link to or integrate third-party sites or services (for example community chat, analytics, maps, or authentication). Those services have their own terms and privacy practices. We are not responsible for third-party content or conduct.

8. Changes, availability, and termination

We may modify, suspend, or discontinue features or the Service (in whole or in part) with or without notice. We are not liable for any change, suspension, or loss of data except where law does not permit exclusion.

We may suspend or terminate your access if you breach these Terms, if we must comply with law, or to protect the Service or users. You may stop using the Service at any time. Provisions that by their nature should survive (including intellectual property, disclaimers, limitations of liability, and governing law) will survive termination.

9. Disclaimers

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any information (including statistics or rankings) will be accurate or complete.

10. Limitation of liability

To the fullest extent permitted by applicable law, we and our directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities, arising from or related to your use of the Service, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability for any claims arising from or related to the Service or these Terms will not exceed the greater of (a) the amounts you paid us for the Service in the twelve (12) months before the claim or (b) one hundred Australian dollars (AUD $100), if you have not paid fees. Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the maximum permitted by law.

11. Indemnity

You agree to indemnify and hold harmless us and our affiliates, and our respective directors, employees, and agents, from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your breach of these Terms, except to the extent caused by our gross negligence or wilful misconduct.

12. Privacy

Our collection and use of personal information is described in our Privacy Policy, which forms part of your agreement with us.

13. General

Governing law. These Terms are governed by the laws of New South Wales, Australia, without regard to conflict-of-law principles. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia sitting in New South Wales.

Entire agreement. These Terms, together with the Privacy Policy and any additional terms we present for specific features, constitute the entire agreement between you and us regarding the Service.

Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in effect.

Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.

No waiver. Failure to enforce any provision is not a waiver of our rights.
